Protect Your Family, Assets, and Legacy with a Plan Built for the Future

Vitale Law Firm helps individuals, families, retirees, and business owners throughout St. Charles County create estate plans tailored to their goals. Whether you are preparing your first will, establishing a trust, planning for long-term care, or updating an existing plan, our attorneys provide clear guidance so you can make informed decisions about your future.

From our conveniently located Wentzville office, we serve clients throughout St. Charles County, including St. Charles, St. Peters, O’Fallon, Wentzville, Lake Saint Louis, Cottleville, Dardenne Prairie, Weldon Spring, and surrounding communities.

Why Does Estate Planning Matter?

Estate planning gives you control over what happens to your assets, your healthcare decisions, and the people who depend on you. A well-designed plan can identify who will manage your affairs if you become incapacitated, determine how your property will pass to your beneficiaries, and provide instructions for caring for minor children or other loved ones.

Without an estate plan, Missouri law may determine who receives your property, and your family may need to navigate additional court proceedings. Planning ahead can reduce uncertainty, protect the people you love, and give your family a clear path forward during an already difficult time.

The Benefits of Estate Planning

An estate plan is about much more than deciding who receives your property. It can help your family avoid confusion, minimize conflict, prepare for incapacity, and make the transfer of assets more efficient.

Depending on your needs, estate planning may help you:

  • Select trusted individuals to manage your financial and medical decisions
  • Name guardians for minor children
  • Direct how and when beneficiaries receive their inheritance
  • Protect a loved one with disabilities
  • Reduce the time and expense associated with probate
  • Prepare for nursing home and long-term care costs
  • Preserve a family business for the next generation
  • Keep important family and financial matters private

The right plan gives your loved ones clear instructions while helping you remain in control of the decisions that matter most.

Tailored Strategies for St. Charles County Families

We recognize that no two families are alike.

No two families have the same priorities. A young family in O’Fallon may need to name guardians and create a trust for minor children. A retiree in St. Peters may be concerned about long-term care expenses. A Wentzville business owner may need a succession plan that protects both the company and the family members who depend on it.

That is why Vitale Law Firm does not rely on one-size-fits-all documents. We build each estate plan around your assets, relationships, responsibilities, and goals. As your life changes, we can also help review and update your documents so your plan continues to work as intended.

Experienced Missouri Estate Planning Attorneys

Since 2017, Vitale Law Firm has helped Missouri families and business owners make confident decisions about their futures. Our Wentzville attorneys explain legal options in plain English, provide transparent pricing, and develop practical strategies based on each client’s goals.

We believe estate planning should give you clarity and confidence, not leave you with more questions. From your initial evaluation through the signing and future review of your documents, our team is here to guide you through the process.

Planning to Avoid Unnecessary Probate

Probate is the court-supervised process used to settle certain estates after someone dies. For St. Charles County residents, probate matters are handled through the Probate Division of Missouri’s 11th Judicial Circuit Court. The county advises that an attorney is required when filing an estate valued above $40,000, as well as for certain guardianship and conservatorship matters.

Not every asset necessarily passes through probate. Trusts, beneficiary designations, jointly owned property, and other planning tools may allow certain assets to transfer outside the court process. Our attorneys can review how your property is titled and help you build a coordinated plan that may reduce unnecessary delays, expenses, and complications for your family.

Frequently Asked Questions

Here are answers to some of the most common questions we hear about estate planning in Missouri

Yes. Estate planning is not only for wealthy families. If you own property, have children, operate a business, or want someone you trust to make decisions if you become incapacitated, an estate plan can provide important protections. Anyone with loved ones, property, or personal wishes should have a plan in place.

A will outlines how your assets will be distributed after your death and must go through probate court. A trust, on the other hand, can transfer assets directly to beneficiaries without probate, offering more privacy, control, and efficiency.

Certain planning strategies may reduce the number of assets that must pass through probate. These can include living trusts, beneficiary designations, transfer-on-death designations, and properly structured ownership arrangements. Whether a particular strategy is appropriate depends on your property and family circumstances.

If you don’t have valid powers of attorney, your family may need to go through court to obtain guardianship or conservatorship to make financial and medical decisions for you. Proper planning avoids this stressful and costly process.

Yes. A standard inheritance can jeopardize eligibility for benefits like Medicaid or SSI. Through special needs trusts and coordinated planning, we can ensure your loved one is cared for financially without losing essential government support.

Yes. Our attorneys can review an estate plan prepared by another firm to determine whether it still reflects your wishes and complies with your current needs. We can recommend updates if your family, finances, goals, or the law have changed.

Probate matters for county residents are handled through the Probate Division of the 11th Judicial Circuit Court in St. Charles. The correct process depends on the type and value of the property involved, how the assets are titled, and whether the deceased person left a valid estate plan.

Yes. From our Wentzville office, Vitale Law Firm serves families and business owners throughout St. Charles County, including St. Charles, St. Peters, O’Fallon, Lake Saint Louis, Cottleville, Dardenne Prairie, Weldon Spring, and nearby communities.
